dc.description.abstractЦелта на работата е да се оцени потребността и възможностите за въвеждане на обективни критерии за определяне на “опасността за живота” при медико-биологичната квалификация на телесните повреди в съдебномедицинската практика в България. Анализирани са 12428 експертизи. Направени са следните изводи: -Установи се съществено разминаване между преценките на СМ експерти при медико-биологичната квалификация на едни и същи травми. -Различията се дължат и на липсата на единни критерии за оценка тежестта на травмите. -Доказа се приложимостта на системата AIS и на руски подход за оценка тежестта на травмите в СМ експертизи. -Установи се, че към българската квалификация „постоянно общо разстройство на здравето, опасно за живота” не спадат реално по-тежките от медицинска и експертна гледна точка травми, застрашаващи живота. -Необходимо е създаване на подзаконов нормативен документ от МЗ, които да уеднакви работата на съдебномедицинските експерти. -Анализът на юридическите практики по света, а и медицинската логика, изискват „опасните за живота” увреждания да не се разделят в различни по степен на тежест юридически категории. Няма по ценно човешко благо от живота и следователно всяка реална заплаха на живота би следвало да се оценява като тежка телесна повреда - Препоръчва се текстовете на НК да се променят по следния начин: - В Чл.128 от НК формулировката „постоянно общо разстройство на здравето, опасно за живота” да се замени с „разстройство на здравето, опасно за живота”. - В чл. 129 от НК да се премахне формулировката „разстройство на здравето, временно опасно за живота”. - Тази промяна би позволила въвеждането на обективни методи за определяне тежестта на травмите и ще създаде предпоставки за уеднаквяване на работата на експертите.BG
dc.description.abstractThe aim of this study is to assess the need and potential for introducing objective criteria determining "danger to life" in medical and biological characterization of injuries in Bulgarian forensic practice. The following conclusions were made based on the analysis of 12,428 expertise: In terms of medico-biological characterization of similar or the same type of injuries significant discrepancies in the assessments of forensic experts were established. Differences are due to the lack of uniform criteria for assessing the severity of injuries. The applicability of AIS system (Abbreviated Injury Scale), along with the Russian approach for severity of injuries assessment, has been verified. It has been established that the Bulgarian qualification of "permanent general health disorder with danger to life" does not actually incorporate more severe life-threatening injuries assessed as such in medical and expert perspective. The necessity for creation and adoption of regulatory documents by the Ministry of Health aimed to unify the criteria for forensic assessments has been put forth. Analysis of foreign judicial practices, along with medical logic indicate that "danger to life" injuries cannot be divided into different degrees of severity legal categories. Human life is the ultimate value and therefore any real danger to life should be assessed as severe injury or mayhem. Recommendations for changes in some texts of the Penal Code have been made as follows: - In Article 128 of the Penal Code the wording "permanent general health disorder with danger to life“, to be replaced by "health disorder with danger to life"; - In Article 129 of the Penal Code the wording "health disorder with temporary danger to life", to be removed. - The change would potentiate the introduction of objective methods for determining the severity of injuries and would advance preconditions for unification of experts’ criteria and assessments.en_US
